While most licenses and contracts are designed to restrict usage, these Terms and Conditions of Use are intended to clarify the relationship between the Company and its users and define the boundaries of responsibility and system usage.

  1. Definitions and Terms: In this document:
    • “Company” or “we” refers to Tamleluya LTD
    • “System” refers to the automatic transcription system
    • “User” or “you” refers to any person or entity using the system
    • “Products” refers to any transcription created through the system
    • “Source file” refers to the original recording uploaded to the system
    • “Service” refers to all services provided by the Company
  2. System Status and Liability Limitation
    1. Product and Beta Versions
      • The system is in development and testing phases
      • Errors, bugs, and malfunctions may occur
      • System performance may vary
      • The Company makes no commitment to system stability
    2. AS IS
      • The system is provided as is
      • No guarantee of fitness for any particular purpose
      • No commitment to support specific formats
      • No commitment to continuous system availability
  3. User Rights and Obligations
    1. Permitted UseThe user may:
      • Upload audio files to the system
      • Receive transcriptions of files
      • Edit and modify received transcriptions
      • Keep copies of transcriptions
    2. Usage Restrictions It is strictly prohibited to:
      • The user must be 18 years anor older and have right to the content
      • Upload content that infringes copyright
      • Upload recordings without participants’ consent
      • Use illegal or offensive content
      • Attempt to bypass system technical limitations
      • Distribute or sell the service to third parties
  4. Ownership and Intellectual Property Rights
    1. The Platform and all of the software and functionality is owned by Tamleluya LTD
    2. Content Ownership
      • Ownership of the original recording file remains with the user
      • Ownership of the final transcription file remains with the user
      • The Company may use anonymous data for system improvement
    3. Company Rights:The Company reserves the right to:
      • Improve and update the system
      • Collect statistical usage data
      • Use anonymous information for system improvement
      • Modify or discontinue services
  5. Payments, Cancellations and Refunds
    1. Payment Policy
      • Prices may change without prior notice
      • Payment is made in advance for usage hours
    2. Cancellations and Refunds
      • 14-day cancellation period from purchase date
      • Full refund only if service unused
      • Proportional refund for unused full hours
  6. Technical Failures and Compensation
    1. Technical Failures
      • In case of technical failure exceeding 48 hours, user entitled to credit refund
      • Company will make reasonable effort to resolve issues
    2. Compensation Limitation
      • Maximum compensation limited to amount invested
      • No compensation for indirect or consequential damages
  7. Information Security and Privacy Protection
    1. No Security Guarantee
      • Company makes no commitment to information security
      • Risk of information leakage or breach exists
      • Sensitive information upload not recommended
    2. User Responsibility
      • Backup and preservation of materials
      • Maintaining login details confidentiality
      • Reporting suspected breaches or information leaks
  8. Support and Communication

      • No phone support
      • No weekend or holiday support
      • Company not obligated to resolve all issues
  9. Changes to Terms of Use
    • Company may modify these terms at any time
    • Continued use constitutes agreement to changes
    • User responsible for staying updated on changes
  10. Termination of Service
    1. Termination by User
      • User may discontinue use at any time
      • No refund for partial use
    2. Termination by Company
      • Company may discontinue service at any time
      • Company may block users violating terms
  11. Jurisdiction and Authority
    1. These terms are subject to Israeli law
    2. Exclusive jurisdiction to Tel Aviv-Yafo courts
    3. User must comply with applicable local laws
  12. Absolute Disclaimer of Warranty
    • EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SYSTEM IS PROVIDED “AS IS” AND WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ALL RISKS ASSOCIATED WITH THE QUALITY AND PERFORMANCE OF THE SYSTEM LIE WITH THE USER. SHOULD THE SYSTEM PROVE DEFECTIVE, THE USER ASSUMES ALL COSTS OF REQUIRED SERVICE, REPAIR, OR CORRECTION.
  13. Absolute Limitation of Liability
    • IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OR AGREED TO IN WRITING WILL THE COMPANY OR ANY OTHER PARTY WHO MAY MODIFY AND/OR REDISTRIBUTE THE SYSTEM AS PERMITTED ABOVE, BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SYSTEM (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE OF THE SYSTEM TO OPERATE WITH ANY OTHER PROGRAMS), EVEN IF THE COMPANY OR OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
